These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and Studyply. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Services or the website.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website and tells You about Your privacy rights and how the law protects You. Please read Our Privacy Policy carefully before using Our Service.

Introduction

This website is owned by a sole trader, Anatoly Safiulov and is run under the name - Studyply (not case sensitive, so same as StudyPly, studyply, etc).

The terms “SMART learning”, “SMART tutoring” and “tutoring” mean the same thing and are grouped together. “Tutoring” therefore refers to “SMART tutoring” and vice versa. “Students” and their “Parents” will be referred to as “customers”. The terms “the company”, “us”, “our” and “Studyply” in this document refer to Studyply, it’s owner and all contractors or other representatives of Studyply. The phrases “The website”, “website” or “our website” refer to the website www.studyply.com and all pages within it. “Our services” is a term referring to any support in form of tutoring, essay marking, homework help and others offered, both paid and free. All singular words include their plurals and vice versa. Examples are included for the purpose of explaining only.

Links to Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

Our tutoring and all content is personal opinions of authors/tutors only. They are not official and can only be used as a guide. Studyply takes no responsibility for their correctness/accuracy and will not be held liable for any losses associated with their usage.

Studyply, its owner, contractors or other representatives will not be held liable at all for any loss, regardless of how it arose, how it was suffered or claimed to have been suffered as a result of your use of this website, any of our information sources or our services. We also cannot give any guarantees regarding the correctness and efficacy and usefulness of any information, or any interpretation of it, provided by the website, our resources, our services or in any other way by Studyply.

Studyply is an advisory service and we do not make any guarantees about the outcome of any exams taken by students and cannot be held liable for any undesirable outcomes.

All content/resources and other information provided by Studyply is to be considered advice, and every individual is responsible for choosing how they wish to use such information.

All information provided on the website or in any associated documents is to be considered guidance only. Your use of such information and/or data is therefore entirely at your own risk.

No representations, warranties or terms of any kind are made in respect of this website or its contents, (including, without limitation, any views or comment made, any blog content and the content of our members resources) other than those required by law.

Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Studyply.

The use of any information or resource from this website for commercial gain, teaching, tutoring etc is strictly forbidden

Everything on the website studyply.com, all information, text, ideas (SMART learning and everything associated), design, charts, tables, slogans, graphs, logos and other material. It is all our intellectual property. Nothing can be copied, reproduced, modified and etc from this website, without a written form of consent form the owner (Anatoly Safiulov).

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time without any prior notice.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.

Data we collect and user confidentiality

Studyply does not store any credit card details. Currently all transactions are carried out either through invoicing, PayPal, Apple Pay or other means of payment which you may use during a checkout. All data that we collect can be seen on our Privacy Policy page.

We collect this data to ensure we continue providing you with the best service and for the future time when you contact us again.

Studyply takes photographs of schools and public event venues where we carry out talks and other interactive events. Studyply may use any of the images for marketing purposes, publications for the website and social media sites. Students attending the events may appear in the images taken and to comply with the Data Protection Act 1998 Studyply needs permission before photographs of the student(s) can be taken.

Should you need any copy of your personal data that we collected, please contact us using the contact us form or find our email at the end of this document under Contact Us. The charge of £10 will be applied for providing this.

If you wish to be completely removed from our database, please contact us using the contact us form or find our email at the end of this document under Contact Us. We will do this free of charge.

When you submit the forms, we will use the details you provided to contact you with updates, offers, news and etc relating to Studyply.

Cancellations, refunds and changes to any of our services dates etc

All Tutoring sessions, are refundable (excluding the transaction fees), given that the client provides at least 3 working days notice prior to the session start date. Cancellations of less than 2 working day will not be subject to any refund but can be transferred to another individual for free.

All Studyply essay marking services are non-refundable.

Tutoring sessions may be transferred to other dates (subject to availability) given everyone in the group agrees with the change. Subject to specific situation and time. All changes must happen with at least a 2 day notice beforehand, otherwise the session will expire and you will not be refunded.

If the service remains unused but has been paid for, no refunds will be made.

Only first session of Studyply tutoring is refundable.

All free trial sessions are 30mins long and can only be used once. You cannot register with a different email or name, etc. Failure to comply may result in permanent ban from the website and our services.

Internet is a place of uncertainty and we therefore cannot guarantee error-free running of this website. We therefore will not accept any responsibility for any loss suffered, or claimed to be suffered, due to some problem of the website at any point.

Customers/students cannot make private/direct payments to tutors. This is for the protection of the customer and the tutor.

Our tutors may use resources from external sources. The use of such resources will not make Studyply liable for any copyright.

Tutors cannot contact any student outside Studyply field of view. All contact is made through the means we provide (Whatsapp groups, discord groups, teams groups, etc) and will be closely monitored by our moderators.

Tutors cannot conduct any business with our customers outside our knowledge. Tutors cannot accept payments externally and privately from our customers.

Even if a tutor leaves Studyply, no customer of Studyply can be taken with them. This means that tutors cannot conduct business with the customers Studyply had on their database at any time without formal consent from the owner Anatoly Safiulov.

Failure to comply with any of the above will result in legal consequences for the tutor.

"Invite your friends and get 50% off the course price"

-In order to invite someone, you must have purchased the course you are inviting people to yourself.

-We can alter this agreement or may choose not to provide "50% off a course" at our own discretion.

-You can only get 50% off once, so any courses you purchase from us afterwards will not be eligible for this program for you.

Our Better Grades Guarantee:

At StudyPly, we developed a system for learning that must be strictly followed by students to ensure better results arrive. The tutor will be monitoring a student's performance and aptitude to learning, as well as the ability to follow our system. All requested homework, classwork and other instructions provided by tutors must be completed to see improvement in education. If a student fails to follow our system, unfortunately our guarantee will not apply in that scenario. At the end of the day, it is up to the student to realize the importance of learning and start revising, being consistent with revision and working hard towards achieving great academic success. A tutor can help and guide the student along the way, but if the student does not push themselves to learn, nothing can be done to improve their grades.

"Invite your friends and get free lessons"

In order to invite someone, you must be our regular student. That means that you must have paid for at least 5 lessons with one of our tutors.

You can get free lessons according to the following tiered system:

-When the total number of friends brought exceeds 5 people, you will only get a free lesson for bringing 5 friends at a time.

By inviting your friends, you and your friends agree to all our terms and conditions and confirm that you have read and understood them.

We can alter this agreement or may choose not to provide free lessons at our own discretion.

Rules for using our social media groups and platforms for communication

All social media platforms have their own rules, privacy policies, cookie policies, terms and conditions and etc. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

The following rules must always be followed and cannot be broken by the student/user or the tutor under any circumstances, failure to do so will results in permanent ban from the website and our services. For example, we strongly discourage and will not tolerate:

-Discrimination/Racism/Hate, etc

-Spam

-Breach of copyright through piracy

-Discussions of politics

-Any forms of sexual language

-Irrelevant discussions

-Disrespectful behaviour
